BC MIAMI LLC Terms of Service (also known as Mr Yachts )
PLEASE READ THESE TERMS OF SERVICE CAREFULLY.
BC MIAMI LLC provides an INSTAGRAM platform that connects Owners who have Boats and Yachts to rent with Renters seeking to rent such Boats and Yachts, which platform is accessible at @mr_yachtsi and any other websites through which BC MIAMI LLC makes the platform available, like FACEBOOK “Mr Yachts” and www.misteryachts.com (collectively, the “Site”) with any other websites, applications, features, software or services provided, owned, or operated by BC MIAMI LLC that link to these Terms are, collectively, the “Services”. You understand and agree that BC MIAMI LLC is not a party to any agreements entered into between owners and renters, nor is BC MIAMI LLC an insurer. BC MIAMI LLC has no control over the conduct of owners, renters and other users of our services or any boats, yachts, jet ski, and disclaims all liability in this regard
Appointment of BC MIAMI LLC as Limited Payment Agent for Owner and
RentersEach Owner and Renter hereby appoints BC MIAMI LLC as the Owner’s limited agent solely for the purpose of collecting payments made by Renters on behalf of the Owner. Each Owner and Renter agrees that payment of Boat or Yacht Fees made by a Renter to BC MIAMI LLC shall be considered the same as a payment made directly to the Owner and the Owner will make the Boat available to Renter in the agreed upon manner as if the Owner has received the Boat Fees. Usually Renters make a deposit to BC MIAMI LLC and the remaining balance is paid on the day of the trip to the Owner or BC MIAMI LLC
Bookings and Financial Terms for Renters
The Owners, not BC MIAMI LLC, are solely responsible for honoring any confirmed bookings and making available any Boats or Yachts reserved through our Services. If you, as a Renter, choose to enter into a transaction with an Owner for the booking of a Boat, you agree and understand that you will be required to enter into an agreement with the Owner and you agree to accept any terms, conditions, rules and restrictions associated with such Boat imposed by the Owner. You acknowledge and agree that
you, and not BC MIAMI LLC, will be responsible for performing the obligations of any such agreements, that BC MIAMI LLC is not a party to such agreements, and that, with the exception of its obligations hereunder to pay Boat Fees to the applicable Owner, BC MIAMI LLC disclaims all liability arising from or related to any such agreements. You acknowledge and agree that, notwithstanding the fact that BC MIAMI LLC is not a party to the agreement between you and the Owner, BC MIAMI LLC acts as the Owner’s limited payment agent for the limited purpose of accepting payments from you on behalf of the Owner. Upon your payment of amounts to BC MIAMI LLC which are due to the Owner, your payment obligation to the Owner for such amounts is extinguished, and BC MIAMI LLC is responsible for remitting such amounts, less BC MIAMI LLC’s Reservation Fees, to the Owner. In the event that BC MIAMI LLC does not remit any such amounts to an Owner, such Owner will have recourse for such amounts only against BC MIAMI LLC.
Indemnification
You agree to release, defend, indemnify, and hold BC MIAMI LLC and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, injuries, death, losses and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to or use of the Services or Collective Content or your violation of these Terms; (b) your Member Content; (c) your (i), booking or use of a Boat, (ii) the use, condition or rental of a Boat by you, including, but not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a rental, booking or use of a Boat
You agree that by paying a deposit, participating in the Referral Program, using our Services , you are agreeing to enter into a legally binding contract with BC MIAMI LLC,. If you do not agree that these Terms of Service (“Terms”) form a contract with you, or should you not wish to agree to these Terms, do not make a deposit and do not use any of the Services. Instructions for deposit payment are at the end, and making such deposit also means you have read and agreed to our Terms of Service
Cancelation; once deposit is made there’s no refund on cancellation nor no show, if severe weather and the captain says it is not safe to navigate a reschedule will occur, and trip starts at said time, renter is responsible to arrive at least 30 minutes prior to trip start time.
I have read and agreed to this terms, and I am 21 years of age or older, therefore I am making a deposit to one of the followings accounts;
